1. Acceptance of Terms
Please read these Terms carefully. They include disclaimers of warranties, limitations of liability, and the governing law and dispute resolution provisions.
These Terms of Service (the "Terms") form a binding agreement between you and Shenzhen Xinhui Yuntu Technology Co., Ltd. ("Xintu Vision", "we", "us") governing your use of the Xintu Vision (芯图视界) mobile application (the "App") and its related cloud services (together, the "Service").
By creating an account or using the Service, you accept these Terms. If you do not agree, please do not register or use the Service. We will also ask you to accept our Privacy Policy, which explains how we handle your personal data.
2. Service Description
The Service lets you set up, manage, and control Xintu Vision security cameras from the App, and may include:
- live video viewing and two-way voice intercom with your cameras;
- alarm and event notifications;
- optional cloud storage plans for storing and reviewing recordings;
- other features we may add over time.
Some features require a working internet connection and compatible camera hardware. We may add, change, or retire features as the Service evolves; if a change materially reduces a paid feature you rely on, we will tell you in the App.
3. Account Registration and Security
- You must provide accurate and complete registration information (mobile number or email address) and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account. If you suspect unauthorized use, change your password and contact us promptly.
- You must be of legal age to form a binding contract in your jurisdiction. The Service is not directed to children (see the Privacy Policy).
- Do not create accounts by impersonating others or with misleading names, and do not use the Service for unlawful purposes.
You may delete your account at any time; see §11 for how termination and deletion work.
4. Purchases and Subscriptions
- Cloud storage and other paid features are optional. Prices, durations, and what is included are shown on the purchase page before you buy.
- Paid plans are valid for the period stated at purchase. Where a payment platform or app store provides its own billing and cancellation rules, those rules also apply.
- Refunds, where required by applicable consumer law or by the rules of the payment channel you used, are handled according to those laws and rules.
- If you delete your account, unused cloud storage is deleted together with the account and cannot be restored — download anything you want to keep first.
5. Acceptable Use
You agree not to use the Service to:
- record or monitor persons without their consent where doing so violates applicable law;
- install cameras in places where you do not have the right to install them;
- break any applicable law or regulation, or infringe the rights of others;
- interfere with or disrupt the Service (for example by probing, scanning, reverse engineering, or overloading our systems);
- resell or commercially exploit the Service without our written permission.
The Service is intended for monitoring your own premises (such as your home or business). Use it responsibly and in accordance with local rules on cameras and recordings.
6. Your Content
- Recordings, snapshots, and face library images that originate from your cameras remain yours. We store and process them only to provide the Service to you.
- You are responsible for the content you create or upload and for having the necessary rights to it.
- We do not pre-screen your content, but we may remove or restrict access to content that appears unlawful or that we are legally required to remove.
7. Intellectual Property
The App, the Service, their design, and their underlying software are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose — nothing more.
You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service except as permitted by applicable law.
8. Third-Party Services
The Service relies on certain third-party providers (for example push notification and crash monitoring services, described in the Privacy Policy). We are not responsible for third-party services that are outside our control, including payment pages you open outside the App. Your use of those services is governed by their own terms.
9. Disclaimers
The Service is provided "as is" and "as available" to the fullest extent permitted by law. While we work to keep the Service reliable, we do not promise it will be uninterrupted, timely, or error-free, and we do not promise that alarm notifications will always be delivered — they depend on your network, your device, and third-party delivery channels.
The Service is a convenience tool, not a substitute for professional security services or emergency response. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunities.
Nothing in these Terms limits rights that cannot be limited under the mandatory consumer protection laws of your place of residence.
11. Term and Termination
- These Terms apply while you use the Service.
- You may stop at any time. You can delete your account and data yourself in the App — deletion takes effect immediately, and the account can no longer sign in.
- We may suspend or terminate the Service (or your account) if you materially breach these Terms, if required by law, or if we discontinue the Service. Where practical, we will notify you beforehand.
- On termination, your right to use the Service ends, and content covered by §6 is handled according to the retention rules in the Privacy Policy.
12. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China (for the avoidance of doubt, excluding Hong Kong, Macau, and Taiwan), without regard to conflict-of-law rules. The place of formation of these Terms is Shenzhen, China.
If a dispute arises, we ask you to contact us first at 15019456993@163.com so we can try to resolve it amicably. If informal resolution fails within thirty (30) days, either party may bring the dispute before a competent court in Shenzhen, China.
Regardless of the above, consumers keep the protections and remedies guaranteed by the mandatory laws of their place of residence, including the right to bring proceedings in the courts of that place where such a right cannot be excluded.
13. Changes and Contact
We may update these Terms from time to time. The current version is always posted on this page with its "Last updated" date; for material changes we will notify you in the App. Continuing to use the Service after an update means you accept the revised Terms.

本用户服务协议（以下简称"本协议"）是您与深圳市芯汇云图科技有限公司（以下简称"芯图视界"或"我们"）之间具有约束力的协议，适用于您对芯图视界移动应用（以下简称"App"）及相关云服务（合称"本服务"）的使用。
注册账号或使用本服务，即表示您接受本协议。如您不同意，请勿注册或使用本服务。我们同时会请您确认《隐私政策》，其中说明了我们如何处理您的个人数据。
二、服务描述
本服务让您通过 App 连接、管理和控制芯图视界安防摄像机，并可能包含：
- 实时视频查看与双向语音对讲；
- 报警与事件通知；
- 可选的云存储套餐，用于存储与回看录像；
- 我们后续可能增加的其他功能。
部分功能需要可用的网络连接和兼容的摄像机硬件。随着服务演进，我们可能新增、调整或下线功能；若某项变更实质性地缩减了您所依赖的付费功能，我们会通过 App 告知您。
三、账号注册与安全
- 您应提供准确、完整的注册信息（手机号或电子邮箱），并保持其最新。
- 您有责任妥善保管密码，并对账号下的全部活动负责。如怀疑账号被盗用，请立即修改密码并联系我们。
- 您须达到您所在司法辖区订立具有约束力合同的法定年龄。本服务不面向儿童（见《隐私政策》）。
- 不得冒充他人或使用误导性名称注册账号，不得将本服务用于非法目的。
您可以随时删除账号；终止与删除的规则见第十一节。
四、购买与订阅
- 云存储等付费功能为可选项目。价格、有效期与所含内容均在购买前的页面上展示。
- 付费套餐按购买时标明的有效期生效。支付平台或应用商店另有计费与取消规则的，从其规定。
- 在适用消费者保护法律或您所用支付渠道规则要求时，退款按相应法律与规则处理。
- 注销账号时，未使用完的云存储将随账号一并删除且无法恢复——请先自行下载需要保留的内容。
五、可接受使用
您承诺不利用本服务：
- 在违反适用法律的情况下未经他人同意对其进行录制或监控；
- 在您无权安装摄像机的场所安装摄像机；
- 违反任何适用法律法规，或侵犯他人权利；
- 干扰或破坏本服务（例如探测、扫描、逆向工程或使系统过载）；
- 未经我们书面许可转售或商业性利用本服务。
本服务旨在用于监控您自己的场所（例如住宅或经营场所）。请您负责任地使用，并遵守当地关于摄像机安装与录音录像的规定。
六、您的内容
- 来源于您摄像机的录像、截图与人脸库图片归您所有。我们仅为向您提供服务而存储和处理这些内容。
- 您对自行创建或上传的内容负责，并保证拥有相关必要权利。
- 我们不会预先审查您的内容，但可能对疑似违法内容或依法须删除的内容予以移除或限制访问。
七、知识产权
App、本服务及其设计、底层软件归我们或我们的许可方所有，受知识产权法律保护。本协议授予您一项有限的、可撤销的、非独占的、不可转让的许可，仅限于按预期目的使用本服务。
除适用法律允许外，您不得复制、修改、分发、销售、出租或逆向工程本服务的任何部分。
八、第三方服务
本服务依赖部分第三方提供者（例如《隐私政策》中所述的推送与崩溃监控服务）。对不在我们控制范围内的第三方服务（包括您在 App 外打开的支付页面）我们不承担责任，您对该类服务的使用受其自身条款约束。
九、免责声明
在法律允许的最大范围内，本服务按"现状"与"可用"状态提供。我们尽力保持服务稳定，但不承诺服务不中断、及时或无差错，也不承诺报警通知必然送达——送达依赖于您的网络、设备与第三方投递通道。
本服务是便利性工具，不能替代专业安防服务或应急响应。本协议的任何内容均不排除依法不可排除的责任。
十、责任限制
在适用法律允许的最大范围内，我们就本服务承担的全部责任，以引起索赔事件前十二（12）个月内您向我们支付的金额为限。
我们不承担间接损失、附带损失、特殊损失、惩罚性赔偿，以及利润损失、数据损失或商业机会损失。
本协议的任何内容均不限制您住所地强制性消费者保护法律所赋予、且不可限制的权利。
十一、期限与终止
- 本协议在您使用本服务期间持续有效。
- 您可以随时停止使用。您可以在 App 内自行删除账号及数据——删除立即生效，账号随即无法再登录。
- 如您实质性违反本协议、法律要求或本服务停运，我们可能暂停或终止本服务（或您的账号）。可行时我们会提前通知您。
- 协议终止后，您使用本服务的权利即告结束，第六节所述内容按《隐私政策》的保留规则处理。
十二、适用法律与争议解决
本协议适用中华人民共和国法律（为本条之目的，不含香港、澳门及台湾地区法律），不受冲突法规则影响。本协议签订地为中国深圳。
如发生争议，请先通过 15019456993@163.com 与我们联系，协商解决。若三十（30）日内未能友好解决，任何一方均可将争议提交中国深圳有管辖权的人民法院裁判。
无论前述约定如何，消费者均保留其住所地强制性法律所保障的保护与救济，包括在该等权利不可排除时向住所地法院提起诉讼的权利。
十三、变更与联系
我们可能不定期更新本协议。最新版本始终发布于本页面并标注"更新日期"；重大变更会通过 App 通知您。更新后继续使用本服务即视为接受修订后的协议。
